In Spain the exchange of contracts is arranged by a pre-contract (called a contract de arras), signed by the seller and buyer. In addition, a down payment is usually made which varies according to the negotiations. The remaining amount will be paid to the notary, who can be seen as the two solicitors united into one person. This is the only authorized person to execute the purchase deed, which is a requirement to register the house into the land registry. The notary verifies if the land or house is burdened with any debts, disputes or other events, registered at the land registry.
